Site Sign In - Terms & Conditions

  1. 1. Payment

For standard setups payment will be made via credit card/PayPal. Any additional customizations will be invoiced on completion with payment due 20th of the following month. Hosting fees of $18+gst will be charged automatically each month (repeating on the date of your order) via PayPal.

  1. 2. Cancellation

You can cancel anytime through PayPal or by emailing info@dvelopit.co.nz After the service has been cancelled your site sign in link will no longer work, and you will no longer have access to view or export the data. Please make sure you export all your form data before cancelling if you are required to keep this information.

3. Ownership

Dvelop IT will provide a finished product to the client in the form of a mini-website. The delivered platform does not become the exclusive property of the client. These files are partially based on a non-exclusive code base created and maintained by Dvelop IT and in some cases existing code was used to help create the deliverables. Such code and other underlying technologies do NOT become the property of the Client, only the finished product(s). In addition, the finished product(s) may depend on code, objects, and other third party utilities that are the property of their respective owners. No rights to these dependencies is expressed or implied. Additional licensing may be required for non-standard customisations.

All data from form submissions remains property & responsibility of the client. Dvelop IT will not use any submitted form data from entries to your Site Sign In form.

  1. 4. Limited Liability

The Client alone shall be responsible for: (a) the accuracy and adequacy of information and data furnished for processing; (b) any use made by the Client of the output of the Software or any reliance thereon; and (c) obtaining the required licenses and respect copyright for any and all third part assets including but not limited to fonts, media, and software.

Dvelop IT  shall have the right to make any changes to the Services which are necessary to comply with any applicable law or safety requirement, or which do not materially affect the nature or quality of the Services, and will notify the Customer in any such event.

Dvelop IT warrants to the Customer that the Services will be provided using reasonable care and skill and in accordance with the Specification.

Dvelop IT accepts no liability for services, and gives no warranty or guarantee as to the quality or suitability of services, provided by third parties whether or not provided through the Supplier or directly to the Customer, including but not limited to the hosting of the Customer’s website, domain name providers / registrars, website software, plugins, frameworks, code libraries, security frameworks & SSL certificate providers, and third party payment gateways. 

  1. 5. Warranty

Dvelop IT will provide patches and bug fixes for any bugs or issues included in the scope of the standard functionality provided by the site sign in forms. All bug fixes outside of the project scope (e.g maintaining custom requested features) may incur additional changes. Dvelop IT will always provide a quote before beginning any custom work so there will be no surprises.

  1. 6. Security & Framework updates

Due to security threats, software and hardware changes the framework used to build your website requires updates to ensure it remains safe and works as fast and efficiently as possible. Dvelop IT will perform the required framework updates to keep your site sign in form working.  If you request custom features there may be additional fee’s associated with maintenance & updates. We will be clear about this and will always provide a quote before beginning any custom work.

Although Dvelop IT makes every effort to provide secure Finished Product(s), due to the nature of rapidly advancing technology, Dvelop IT can in no way guarantee that the Finished Product(s) will not be subject security breaches. Dvelop IT recommends the use of strong passwords and the observance of standard security practices for your admin login. In order to minimize the chances of security violations Dvelop IT follows accepted security practices such as regular framework updates, daily backups (on a 7 day rotation) and SSL certificates.

  1. 7. Acceptance

This contract will be considered accepted by either: (1) the deposit of funds to Dvelop IT (either by credit card or bank deposit), or (2) by ordering the site-sign in form on our website.
